To be covered under the Virginia Workers’ Compensation Act, an accident must:
- occur at work or during a work related function
- be a result of a specific work activity
- have occurred at a specific time
Injuries incurred gradually or from repetitive stress or traumas are not covered. Occupational diseases are covered if caused by the work, and not a disease of the back, neck, or spinal column. This is a subject of constant change.
Technically, no employee should need an attorney to pursue a claim for workers' comp benefits. Unfortunately, that is not true. Employers are required by law to have workers’ compensation insurance. An employer has an economic interest in denying a claim—the more claims that a company has against them, the faster the premiums go up.
